Its focus on fairness, transparency, and competition is reshaping the way that the designated gatekeepers, businesses, developers, and users work, play, and otherwise interact in the online ecosystem.<\/p>\n\n\n\n<p>For businesses, understanding the DMA is not explicitly about avoiding fines. But it is about future-proofing marketing and data privacy practices to align with ongoing developments in the gatekeepers\u2019 policies. To maintain compliance, these companies have passed down policy requirements to other companies using their platforms.<\/li>\n<\/ul>\n\n        <\/div>\n    <\/div>\n<\/div>\n\n            <\/div>\n        <\/div>\n    <\/div>\n<\/div>\n\n\n\n<p>The Digital Markets Act (DMA) is an EU regulation designed to enhance data privacy, control the influence of large global tech companies, and ensure fair competition in digital markets.&nbsp;<\/p>\n\n\n\n<p>The DMA designates \u201cgatekeepers\u201d, which are large online platforms with considerable influence over smaller businesses, consumers, and global digital markets. These gatekeepers are the entities required to comply with the DMA\u2019s requirements.&nbsp;<\/p>\n\n\n\n<p>As of late 2025, seven have been designated, but in the future existing ones could be removed (e.g. Samsung was initially considered) and new ones could be added.<\/p>\n\n\n\n<p>In order for gatekeepers to comply with the Act\u2019s requirements, like enhancements to data privacy, they need to ensure compliance throughout their ecosystems. Some have created or updated policies with requirements for smaller partner organizations.&nbsp;<\/p>\n\n\n\n<p>While smaller companies would not be fined under the DMA for not complying with gatekeepers\u2019 requirements, they could lose access to functions on their platforms, or access to the platforms entirely.<\/p>\n\n\n\n<p>The gatekeepers control critical digital services, such as online search engines, app stores, ecommerce platforms, payment processors, web browsers, messaging services, and social networks. By imposing strict requirements across the EU, the DMA seeks to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Prevent unfair practices by gatekeepers<\/li>\n\n\n\n<li>Strengthen user rights over data access and portability<\/li>\n\n\n\n<li>Ensure more transparency in digital services<\/li>\n\n\n\n<li>Create a more level competitive playing field for startups and SMBs<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-digital-markets-act-summary\">Digital Markets Act summary<\/h2>\n\n\n\n<p>The EU DMA law applies to companies that meet criteria for gatekeeper designation, which include significant impact on EU digital markets (though all the gatekeepers are global enterprises), have a large base of business and end users, and entrenched market positions.<\/p>\n\n\n\n<p>At its core, the DMA provides a list of do\u2019s and don\u2019ts for the designated gatekeepers. The Act has a number of key objectives meant to curb potentially anti-competitive business behaviors. These include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>End self-preferencing, where a gatekeeper favors its own services in rankings or visibility<\/li>\n\n\n\n<li>Mandate data-sharing with business users and competitors<\/li>\n\n\n\n<li>Guarantee users the ability to uninstall apps, switch defaults, and access alternative payment systems<\/li>\n\n\n\n<li>Preventing reuse of data collected from business users to compete against them<\/li>\n<\/ul>\n\n\n\n<p>The DMA\u2019s jurisdiction, like with the <a href=\"https:\/\/usercentrics.com\/us\/knowledge-hub\/the-eu-general-data-protection-regulation\/\">GDPR<\/a>, is business operations in the European Union (EU) and European Economic Area (EEA).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-digital-markets-act-timeline\">Digital Markets Act timeline<\/h2>\n\n\n\n<p>The Digital Markets Act was proposed along with the <a href=\"https:\/\/usercentrics.com\/us\/knowledge-hub\/differences-between-digital-markets-act-and-digital-services-act\/\">Digital Services Act (DSA)<\/a>, with the combined legislation referred to as the <a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/digital-services-act-package\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Digital Services Act package<\/a>. The DSA governs online content, safety, and liability.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The European Commission (EC) submitted their proposal for the DMA law to the European Parliament in December 2020.&nbsp;<\/li>\n\n\n\n<li>Complaints by large online platforms and lobbying efforts against the DMA and gatekeeper status began as early as late 2020.<\/li>\n\n\n\n<li>The law\u2019s text was formally adopted in December 2021.&nbsp;<\/li>\n\n\n\n<li>The law was formally adopted by the European Parliament in July 2022.<\/li>\n\n\n\n<li>The law came into force in May 2023.<\/li>\n\n\n\n<li>The initial six gatekeepers had to comply by March 2024, and noncompliance investigations were opened then against Alphabet, Apple, and Meta.<\/li>\n\n\n\n<li>Booking.com was added as a seventh gatekeeper in May 2024, and had six months to achieve compliance with the DMA\u2019s requirements.<\/li>\n\n\n\n<li>The EC announces noncompliance findings against Google, Apple, and Meta in April 2025 and issues fines.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-digital-markets-act-gatekeepers\">Digital Markets Act gatekeepers<\/h2>\n\n\n\n<p><a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2022\/1925\/oj\/eng\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Article 3 of the DMA<\/a> outlines the criteria defining a gatekeeper position. Companies had to notify the EC by July 2023 if they met these thresholds. They include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Significant impact on the internal market<\/li>\n\n\n\n<li>Provide a core platform service that is an important gateway for business users to reach end users<\/li>\n\n\n\n<li>Enjoy an entrenched and durable position<\/li>\n\n\n\n<li>Meet specific thresholds for revenue \u2014 EUR 7.5 billion annual EU turnover or EUR 75 billion market capitalization \u2014 and user numbers \u2014 45 million monthly active end users and 10,000 yearly active business users in the EU<\/li>\n<\/ul>\n\n\n\n<p>When the DMA came into effect in 2023, there were six gatekeepers designated, with Booking.com added in May 2024:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Alphabet (Google, YouTube, etc.)<\/li>\n\n\n\n<li>Amazon<\/li>\n\n\n\n<li>Apple<\/li>\n\n\n\n<li>Booking.com<\/li>\n\n\n\n<li>ByteDance (TikTok)<\/li>\n\n\n\n<li>Meta (Facebook, Instagram, WhatsApp, etc.)<\/li>\n\n\n\n<li>Microsoft<\/li>\n<\/ul>\n\n\n\n<p>The original six gatekeepers had until March 2024 to comply with the law, and Booking.com had to comply by November 2024.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-core-platform-services-under-the-dma-law\">Core platform services under the DMA law<\/h3>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" height=\"700\" width=\"900\" src=\"https:\/\/usercentrics.com\/us\/wp-content\/uploads\/sites\/7\/2024\/01\/uc_blog_Core-platform-services-under-the-DMA-law.svg\" alt=\"\" class=\"wp-image-15781\"\/><\/figure>\n\n\n\n<p>Operating one or more core platform services (CPS) is one of the criteria for gatekeeper designations, and to date these CPS are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Four social networks (Facebook, Instagram, LinkedIn, TikTok)<\/li>\n\n\n\n<li>Two large communication services (Facebook Messenger and WhatsApp)<\/li>\n\n\n\n<li>Six \u201cintermediation\u201d platforms (Amazon Marketplace, Google Maps, Google Play, Google Shopping, iOS App Store, Meta Marketplace)<\/li>\n\n\n\n<li>One search engine (Google)<\/li>\n\n\n\n<li>Two web browsers (Chrome and Safari)<\/li>\n\n\n\n<li>Three online advertising services (Amazon, Google, and Meta)<\/li>\n\n\n\n<li>Three most popular operating systems (Google Android, iOS, Windows PC OS)<\/li>\n\n\n\n<li>One video sharing platform (YouTube)<\/li>\n\n\n\n<li>One online travel agency (Booking.com)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-gatekeepers-obligations-under-the-dma-law\">Gatekeepers\u2019 obligations under the DMA law<\/h3>\n\n\n\n<p>The EC published a list of <a href=\"https:\/\/commission.europa.eu\/strategy-and-policy\/priorities-2019-2024\/europe-fit-digital-age\/digital-markets-act-ensuring-fair-and-open-digital-markets_en\">obligations for the designated gatekeepers<\/a>, in the form of a do\u2019s and don\u2019ts list.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-do-s-for-gatekeepers\">Do\u2019s for gatekeepers<\/h4>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" height=\"400\" width=\"900\" src=\"https:\/\/usercentrics.com\/us\/wp-content\/uploads\/sites\/7\/2024\/01\/uc_blog_dos_for_gatekeepers.svg\" alt=\"\" class=\"wp-image-15782\"\/><\/figure>\n\n\n\n<p>\u2705 Allow third-party interoperability with the gatekeeper\u2019s own services in specific circumstances.<\/p>\n\n\n\n<p>\u2705 Allow their business users to access the data that they generate in their use of the gatekeeper\u2019s platform.<\/p>\n\n\n\n<p>\u2705 Provide companies advertising on their platform with the tools and information necessary for advertisers and publishers to carry out their own independent verification of their advertisements hosted by the gatekeeper.<\/p>\n\n\n\n<p>\u2705 Allow their business users to promote their offers and conclude contracts with their customers outside the gatekeeper\u2019s platform.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-don-ts-for-gatekeepers\">Don\u2019ts for gatekeepers<\/h4>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" height=\"400\" width=\"900\" src=\"https:\/\/usercentrics.com\/us\/wp-content\/uploads\/sites\/7\/2024\/01\/uc_blog_donts_for_gatekeepers.svg\" alt=\"\" class=\"wp-image-15783\"\/><\/figure>\n\n\n\n<p>\u274c Treat services and products offered by the gatekeeper itself more favorably in ranking than similar services or products offered by third parties on the gatekeeper&#8217;s platform.<\/p>\n\n\n\n<p>\u274c Prevent consumers from linking up to businesses outside their platforms.<\/p>\n\n\n\n<p>\u274c Prevent users from uninstalling any preinstalled software or app if they wish so.<\/p>\n\n\n\n<p>\u274c Track end users outside of the gatekeepers&#8217; core platform service for the purpose of targeted advertising, without valid consent having been granted.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-consumers-rights-and-benefits-under-the-dma\">Consumers\u2019 rights and benefits under the DMA<\/h3>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" height=\"450\" width=\"900\" src=\"https:\/\/usercentrics.com\/us\/wp-content\/uploads\/sites\/7\/2024\/01\/uc_blog_Consumers-rights-and-benefits-under-the-DMA.svg\" alt=\"\" class=\"wp-image-15784\"\/><\/figure>\n\n\n\n<p>Among the biggest benefits of the DMA for European consumers online is increased protections and choice. With the goal of spurring competition, companies \u2014 including the gatekeepers \u2014&nbsp;have motivation to improve their products and services. The main benefits of the DMA law for consumers are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Improved product and service quality:<\/strong> Companies (including the gatekeepers) are incentivized to improve their products and services due to increased competition and consumer choice.<\/li>\n\n\n\n<li><strong>Innovation:<\/strong> Big platforms are prevented from using data from smaller companies to create similar or identical, cheaper products. This shifts the focus to genuine innovation and superior customer experience as competitive differentiators.<\/li>\n\n\n\n<li><strong>Easier switching among providers:<\/strong> Consumers can more easily switch between service providers and port their data, significantly reducing barriers previously associated with leaving platforms.<\/li>\n\n\n\n<li><strong>Data control:<\/strong> Individuals gain more control over how gatekeepers use their data. They can decide if their data can be tracked across services or used for marketing purposes, such as profiling for personalized advertising.<\/li>\n\n\n\n<li><strong>Streamlined user experience:<\/strong> Consumers no longer have to log in to one platform to access another, simplifying the online user experience. Also expanded user-friendly options for browsers and search engines.<\/li>\n\n\n\n<li><strong>App installation and management freedom:<\/strong> Individuals can directly install apps from the web or app stores beyond those operated by gatekeepers like Apple and Google. App developers can list their apps in multiple stores and startups can even create their own app stores, with greater control.<\/li>\n\n\n\n<li><strong>Unbiased search results:<\/strong> Search results will prioritize relevance over commercial bias, enabling consumers to discover the best products and services without undue influence from gatekeepers\u2019 marketing and promotions they may not find relevant.<\/li>\n\n\n\n<li><strong>Legal recourse:<\/strong> Consumers have avenues for recourse if their rights are denied. Potential penalties are substantial, and exceed those for GDPR violations. The EC can levy fines of up to 10 percent of total global revenue for the preceding year, or up to 20 percent for repeated infringements (<a href=\"https:\/\/www.eu-digital-markets-act.com\/Digital_Markets_Act_Article_30.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Article 30 of the DMA<\/a>.) There can also be structural remedies required, including divestments when there\u2019ve been repeat infractions.<\/p>\n\n\n\n<p>The EC didn\u2019t waste any time beginning investigations or enforcement, either. In April 2025, Apple was fined EUR 500 million and Meta was fined EUR 200 million for <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_25_1085\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">breach of the anti-steering obligation<\/a> (obligation to give consumers the choice of a service that uses less of their personal data.)<\/p>\n\n\n\n<p>In September 2025 <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_25_1992\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Google was fined<\/a> an unprecedented EUR 2.95 billion for breaching antitrust rules in advertising.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-european-digital-markets-act-impact-on-businesses\">The European Digital Markets Act impact on businesses<\/h2>\n\n\n\n<p>The DMA\u2019s effects are not limited to gatekeepers. Its ripple effects reach every business of every size that operates digitally in Europe.<\/p>\n\n\n\n<p>As noted, some of the gatekeepers have taken actions to enable DMA compliance throughout their business ecosystems. For example, Google established new privacy rules in March 2024, accompanied by enforcement of its <a href=\"https:\/\/www.google.com\/about\/company\/user-consent-policy\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">EU user consent policy<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-digital-markets-act-and-large-enterprises\">The Digital Markets Act and large enterprises<\/h3>\n\n\n\n<p>Large companies are likely to have significant investment into the gatekeepers\u2019 platforms.
