Unlike other state laws, the CPA also mandates opt-in consent for processing sensitive data and imposes stricter data minimization requirements.<\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"h-compliant-data-is-a-critical-business-resource\">Compliant data is a critical business resource<\/h2>\n\n\n<p>Compliance is crucial for companies to avoid fines, data loss, and reputational damage while leveraging privacy practices to build user trust, enhance engagement, and boost revenue. The CPA&#8217;s comprehensive approach underscores the growing importance of privacy compliance in today&#8217;s data-driven market.<\/p>\n<p>These steps will help you achieve compliance with the Colorado Privacy Act (CPA), which applies to and protects residents of Colorado. It applies from that date forward and does not apply retroactively.<\/p>\n            <\/div>\n<\/div>\n\n\n\n\n<h3>Step 2: Create a comprehensive Privacy Policy.<\/h3>\n<ul>\n<li><strong>Purpose:<\/strong> Inform consumers at or before the point of data collection:\n<ul>\n<li>categories of personal data processed<\/li>\n<li>purposes for which data is processed<\/li>\n<li>categories of personal data that the controller shares with third parties, if any<\/li>\n<li>categories of third parties the controller shares personal data with, if any.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Rights:<\/strong> Inform website visitors of their privacy rights and how to exercise them, including contact information and how a consumer may appeal a controller&#8217;s decision with regard to the consumer&#8217;s request.<\/li>\n<li><strong>Language:<\/strong> Ensure the <a href=\"https:\/\/usercentrics.com\/knowledge-hub\/how-to-write-a-privacy-policy\/\">Privacy Policy<\/a> is clear and easy to understand.<\/li>\n<li><strong>Implementation:<\/strong> Make information about privacy and user options, like consent opt-out, available via a banner or pop-up for when users visit your site, e.g. with a Consent Management Platform.<\/li>\n<\/ul>\n<h3>Step 3: Inform users about their rights.<\/h3>\n<p>Consumers\u2019 rights under the CPA:<\/p>\n<ul>\n<li><strong>Right to Access<\/strong>\n<ul>\n<li>request and receive confirmation whether a controller is processing their personal data<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Correction<\/strong>\n<ul>\n<li>updates or corrections to inaccuracies in personal data collected<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Deletion<\/strong>\n<ul>\n<li>personal data that has been collected about them (with exceptions)<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Data Portability<\/strong>\n<ul>\n<li>copy of personal data must be provided in a portable and readily useable format<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Opt Out<\/strong>\n<ul>\n<li>of processing of personal data for the purposes of sale, targeted advertising, or profiling for decisions that would affect the consumer in a legal or similarly significant way<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Non-discrimination<\/strong>\n<ul>\n<li>for exercising privacy rights<\/li>\n<\/ul>\n<\/li>\n<li><strong>Right of Minors<\/strong>\n<ul>\n<li>consent must be obtained from a parent\/guardian if the data subject is a child (under age 13) as regulated by the <a href=\"https:\/\/www.ftc.gov\/legal-library\/browse\/rules\/childrens-online-privacy-protection-rule-coppa\">Children\u2019s Online Privacy Protection Act (COPPA)<\/a><\/li>\n<\/ul>\n<\/li>\n<li><strong>Right to Restrict Use of Sensitive Personal Information<\/strong>\n<ul>\n<li>limit or refuse the collection or use of personal data the law classifies as sensitive<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3>Step 4: As a best practice, review and update your Privacy Policy or Notice every 12 months.<\/h3>\n<ul>\n<li><strong>Review your operations<\/strong> and potential changes in the law every 12 months. Updating your Privacy Policy information and the <strong>effective date<\/strong>. Effective date should be updated even if you don&#8217;t make any other changes to the Policy.<\/li>\n<li><strong>Transparency:<\/strong> Ensure that the information that users must be notified about is clear, comprehensive and up to date.
