It does not apply retroactively.<\/p>\n            <\/div>\n<\/div>\n\n\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-step-2-create-a-comprehensive-privacy-policy\"><strong>Step 2: Create a comprehensive Privacy Policy<\/strong><\/h3>\n\n\n\n<p><strong>Purpose<\/strong>: Inform consumers at or before the point of data collection:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Categories of personal data processed<\/li>\n\n\n\n<li>Purposes for which data is processed<\/li>\n\n\n\n<li>Categories of personal data that the controller shares with third parties, if any<\/li>\n\n\n\n<li>Categories of third parties the controller shares personal data with, if any<\/li>\n<\/ul>\n\n\n\n<div style=\"height:9px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p><strong>Rights<\/strong>: Inform website visitors of their privacy rights and how to exercise them, including contact information and how a consumer may appeal a controller&#8217;s decision with regard to the consumer&#8217;s request.<\/p>\n\n\n\n<p><strong>Language<\/strong>: Ensure the <a href=\"https:\/\/usercentrics.com\/us\/knowledge-hub\/how-to-write-a-privacy-policy\/\">Privacy Policy<\/a> is clear and easy to understand.<\/p>\n\n\n\n<p><strong>Implementation<\/strong>: As a best practice, implement a privacy notice with information about data use, consumers\u2019 rights and user options, like consent opt out. Enable consumers to exercise rights, like opting out, via a <strong>banner or popup<\/strong> when users visit your site, e.g., with a Consent Management Platform.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-step-3-inform-users-about-their-rights\"><strong>Step 3: Inform users about their rights<\/strong><\/h3>\n\n\n\n<p>Consumers\u2019 rights under the TDPSA:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Right to access<\/strong>: request and receive a copy of their personal data<\/li>\n\n\n\n<li><strong>Right to correction<\/strong>: updates or corrections to inaccuracies in personal data collected<\/li>\n\n\n\n<li><strong>Right to deletion<\/strong>: personal data that has been collected about them (with exceptions)<\/li>\n\n\n\n<li><strong>Right to data portability<\/strong>: copy of personal data must be provided in a portable and readily useable format<\/li>\n\n\n\n<li><strong>Right to opt out<\/strong>: of processing of personal data for the purposes of sale, targeted advertising, or profiling for decisions that would affect the consumer in a legal or similarly significant way<\/li>\n\n\n\n<li><strong>Right to nondiscrimination<\/strong>: for exercising privacy rights<\/li>\n\n\n\n<li><strong>Right of minors<\/strong>: consent must be obtained from a parent\/guardian before children\u2019s (under age 13) personal data is collected<\/li>\n\n\n\n<li><strong>Right to restrict use of sensitive personal information<\/strong>: limit or refuse the collection or use of personal data the law classifies as sensitive<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-step-4-as-a-best-practice-review-and-update-your-privacy-policy-or-notice-every-12-months\"><strong>Step 4: As a best practice, review and update your Privacy Policy or Notice every 12 months<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Review your operations<\/strong> and potential changes in the law every 12 months. Updating your Privacy Policy information and the <strong>effective date<\/strong>. Effective date should be updated even if you don&#8217;t make any other changes to the Policy.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Transparency:<\/strong> Ensure that the information that users must be notified about is clear, comprehensive and up to date. Ensure that the date of the last update is clearly visible.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Data sold:<\/strong> List all the categories of personal information that your business has sold in the past 12 months.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-step-5-enable-clear-options-when-consent-is-required\"><strong>Step 5: Enable clear options when consent is required<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>When:<\/strong> If the personal data collected is sensitive or that of a child. options to opt-out and store preferences for processing sensitive personal data.<\/li>\n\n\n\n<li><strong>Consent for Children: <\/strong>Obtain consent from a parent or legal guardian for collection of personal data if the data subject is 13 or younger.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-step-10-enable-consumers-to-make-data-subject-access-requests-dsars\">Step 10: Enable
